Two years seems a bit harsh for copyright infringement. If he had murdered someone and apologized profusely he might only get three years. A defaming a classmate by using his photo? Most of my junior high school class would be in jail if that were true when I was growing up. Still, for releasing a virus: LIFE!
i guess it will be lenient say 6 months suspended for 12 months with a small fine of Y200,000. And if i were to judge, will set him free, because he contributed to j-economy, people must have either bought new computers or got them repaired.
Lock him up? Rubbish! They should give this young man a job where his talents could be put to better use!
As for copyright - my personal view is, if you're going to put images on the net, expect them to be copied! No amount of software will stop people copying and using images!
Defaming his classmate? - Two pairs of boxing gloves and a boxing ring would soon sort that out - but 2 or 3 years in prison? There are drunk drivers doing time for killing people with their vehicles, who got less than this!
Prison isn't going to help this young man, it's going to make him worse when he comes out!

From Nakatsuji's POV: He broke the copyright laws and that isn't a federal offense.
My opinion: I don't entirely understand the Japanese justice system, but I think two years is much too harsh a sentence for either of those actions...
been watching too much TV? there seems to be a popular false image about the supposed talent needed to create a computer virus. what makes you think this guy is a genius? there's actually not much to it. it's not big and it's not clever
