It's probably a difficult issue since it clearly is so obviously wrong, but it's hard to isolate in words exactly what is illegal about it without catching other perfectly legal photographic activities.

I think the problem with making a general principled statement about privacy like 'People have the expectation, when they are in public, of not having their undergarments photographed' is that every case would then have to turn on it's own facts. Specifically, what can be seen in the photo that a child or short adult could not have seen? If we don't criminalize the act of taking the photo itself, it would get even more complicated if there was no dispute that a photo was taken but the evidence was deleted before the police ever arrived. The only alternative seems to be exactly what the police in Japan are doing which is attacking the problem through somewhat unrelated charges.

I would also throw into the debate that some cultures find ankles to be the most erotic thing about a woman. If a woman's shoe were to accidently slip off in public and someone were to take a photo, causing her great personal embarassment, can we say that a crime has occured? (It's just something to think about!)

I didn't find the specific wording of the Massachussets law, but I found the summary which is:

The legislation makes the secret photographing, videotaping, or electronically surveiling of another person's sexual or other intimate parts, whether under or around a person's clothing or when a reasonable person would believe that the person's intimate parts would not be visible to the public, a crime

It's very crafty. The reasonable person standard seems to deal with situations where the photo is deleted but there is some other evidence (witness, cctv etc) about what the photo 'might have' caputured. But it still seems quite difficult to prosecute without clear evidence. I suppose passing any law, whether it can withstand a challenge or not, is enough for US prosecutors since it makes plea bargaining possible.

The reason Massachussets is relevant is because it is the only jurisdiction in the world that seems to have passed a law explicitly criminalizing this sort of behaviour. It could be a blueprint for Japan.

I just googled "Shigetaka Katagiri arrested" and JT is the only English news source with this story. (There are also 2 "blogs" I found with the same story, as far as I looked, that have the same story word for word, apparently getting their news directly from this site)

Let me review the legal definition of voyeurism. In the criminal code a person who, for the purpose of obtaining sexual arousal or sexual gratification observes a person who is engaged in a private act without the consent of the person being observed for that purpose, and knowing that the person being observed does not consent to being observed for that purpose, is guilty of an offence. In other words it is a crime. If a person decides to go see a psychologist or psychiatrist it is up to the professional practioner to evaluate and determine the most appropriate treatment if necessary and then decide whether the person has a disorder or not.
