A 42-year-old Air Self-Defense Force pilot has been arrested after he took photos up a girl's skirt at a train station in Nagareyama, Chiba Prefecture.

According to police, the suspect, identified as Shigetaka Katagiri, took photos up a 27-year-old woman's skirt with his smartphone, while riding an escalator at Nagareyama Otakanomori station at around 10:30 p.m. on Tuesday, TBS reported.

Police said that while taking the pictures, Katagiri's phone came into contact with the woman's buttocks, causing her to notice and cry out. Katagiri attempted to flee the scene, but was chased and caught by the woman and a man who had been nearby at the time.

According to Ministry of Defense officials, in April of this year, Katagiri was transferred from the ASDF to the Ministry of Defense Inspector General Headquarters. As inspector general, Katagiri had been in charge of enforcing sexual harassment prevention protocols.

@Novenachama The legal and psychological definitions are two totally different things. Lots of guys have been busted for this that no psychologist would determine was an actual voyeur in need of psychological treatment.

Taking upskirt photos is not proof that a man that is abnormal or even a pervert. Its just proof that he violated laws and social rules to get what near every man wants.

Don't understand how the phone could come into contact with her buttocks. Way to close to get a decent picture. Maybe bumping her legs, but her buttocks? And I assume the police found at least one picture on his phone. Otherwise, not much of a case. Lastly, JT really should change "girl" to woman. Rather sexist to call a 27 year old a "girl."

@rydangel Agreed. But I think the real arguments happen over the exact reasons why its a problem or even exactly why so many men are doing this. Some people just don't want to hear the truth about some points of masculine nature and think that suggestions of "just watch some net porn" are really going to be a solution.

In truth, men don't really want porn. Porn is just a substitute for what they really want. What they real want is real, live women, and every step closer to that is more compelling than the last. But this method of getting closer to real live women is very selfish, very inconsiderate, and therefore against laws and social norms. But its madness to think average men are not at least tempted. All us straight guys have been tempted. Most of us don't go there simply for fear of being caught and publicly humiliated.

Ha ha! Now that is funny! I have caught perverts with their cameras stuck up a girl's bum over half a dozen times. The first time I tried to nab him and I was the one who got into trouble from the police. He got a warning and was out of there in half an hour. I got detained for nearly two hours and was told by the police to stay out of Japanese business. Another time I enthusiastically asked the guy to show me the photo he took. His reaction was priceless! His jaw dropped and he bolted from the station. Now, I just give them a thump on the shoulder and a dirty look. The reaction is still the same though. Mind you, my understanding is that what these men are arrested for is causing a disturbance in a public place or disrupting business when it happens in a train station. The idea being that JR does not authorize you to do this sort of thing and it hurts their business when you do it. Just like a protester or busker etc.

Despite what most people think, taking these pervy photos is not clearly a crime per se. (Although the physical contact in this particular case would probably amount to a crime). I image that someday one of these guys is going to fight the charges to clarify this point.

It's probably a difficult issue since it clearly is so obviously wrong, but it's hard to isolate in words exactly what is illegal about it without catching other perfectly legal photographic activities.

I think the problem with making a general principled statement about privacy like 'People have the expectation, when they are in public, of not having their undergarments photographed' is that every case would then have to turn on it's own facts. Specifically, what can be seen in the photo that a child or short adult could not have seen? If we don't criminalize the act of taking the photo itself, it would get even more complicated if there was no dispute that a photo was taken but the evidence was deleted before the police ever arrived. The only alternative seems to be exactly what the police in Japan are doing which is attacking the problem through somewhat unrelated charges.

I would also throw into the debate that some cultures find ankles to be the most erotic thing about a woman. If a woman's shoe were to accidently slip off in public and someone were to take a photo, causing her great personal embarassment, can we say that a crime has occured? (It's just something to think about!)

I didn't find the specific wording of the Massachussets law, but I found the summary which is:

The legislation makes the secret photographing, videotaping, or electronically surveiling of another person's sexual or other intimate parts, whether under or around a person's clothing or when a reasonable person would believe that the person's intimate parts would not be visible to the public, a crime

It's very crafty. The reasonable person standard seems to deal with situations where the photo is deleted but there is some other evidence (witness, cctv etc) about what the photo 'might have' caputured. But it still seems quite difficult to prosecute without clear evidence. I suppose passing any law, whether it can withstand a challenge or not, is enough for US prosecutors since it makes plea bargaining possible.

The reason Massachussets is relevant is because it is the only jurisdiction in the world that seems to have passed a law explicitly criminalizing this sort of behaviour. It could be a blueprint for Japan.

I just googled "Shigetaka Katagiri arrested" and JT is the only English news source with this story. (There are also 2 "blogs" I found with the same story, as far as I looked, that have the same story word for word, apparently getting their news directly from this site)

Which is odd. I thought other English sites based on Japanese news would have this story too.

Let me review the legal definition of voyeurism. In the criminal code a person who, for the purpose of obtaining sexual arousal or sexual gratification observes a person who is engaged in a private act without the consent of the person being observed for that purpose, and knowing that the person being observed does not consent to being observed for that purpose, is guilty of an offence. In other words it is a crime. If a person decides to go see a psychologist or psychiatrist it is up to the professional practioner to evaluate and determine the most appropriate treatment if necessary and then decide whether the person has a disorder or not.
