    This is something I've never understood. Why couldn't they just allow paternity tests to prove who the kids father is, and register them accordingly...

    Molenir, you should (try to) understand that, this is japan. they got their own set of rule (which even japanese do not really understand it!!!)

    why dont they just change the law of the 300 days as many countries have done recently !? that would be much simpler !!!...

    Molenir, in some countries, paternity is recognized on a biological basis. In other countries, it is based on a declarative basis, whoever the biological father maybe. However, I wish Japan stops linking birth and marital status of the parents. I think it would be much more fair and modern to switch to a declaration based system independant of marital status, like in many European countries. In a society where divorce and out of wedlock births are increasingly common (not much yet in Japan, but there is a trend), it is not appropriate to continue using laws that were adapted to old society (stable family, no birth out of wedlock, etc...). Furthermore, even in absence of declaration by the father, the biological mother would automatically be registered as the mother and the baby would automatically be granted a residence certificate, except if the mother wants her identity hidden from her baby ("accouchement sous X" in France ; in this case the baby would be under the responsability of social services)
