My guess is, though, that were Kodansha to take it to the Supreme Court they would lose, as Japan is one big Old Boy's club and the Supreme Court would protect Sumo first and foremost. Anyway, they won't take it to the Supreme Court because, unlike the JSA, Kodansha probably wants to maintain its integrity the old fashion way, pay the fine, bow, and apologize, instead of using force to get their way (even though they would be justified).
EVERYONE knows that is match-fixing and corruption in Sumo. Everyone. What's more, almost everyone knows that Sumo is not the sport it once was, and Japan has made a lot of effort and spent a lot of time ensuring they are recognized world-wide for the sport, but trying to limit the wrestlers to people of Japanese nationality (and failed). Hell, the JSA successfully won a light sentence for two people who MURDERED a young wrestler, after they failed to cover it up, of course. The JSA is mentally ill, and an outdated relic.
Everybody says it, everybody knows it? Or everybody is echoing what somebody said somewhere? The writers should reveal their sources, only then would it be believable. The verdict was just.

Seriously, if anything at all, this "decision" just shows how clubby the whole establishment is in this country. Maintain the status quo, don't rock the boat.... The size of the award seems to indicate that Kodansha and others are being slapped down for having the insolence of raising these issues. Moreover, what about the size of the award, Japanese courts are infamous for ordering pittance payments in civil cases, why all the money this time?
42.9 million yen is really small amount. They should have fined kodansha 1000 times of that to make this leechy magazine go bankrupt and that beardy sucker, who calls himslef a journalist, homeless
