9/11 suspects withhold guilty pleas
GUANTANAMO BAY, Cuba —
The self-professed architect of the Sept 11 attacks Khalid Sheikh Mohammed and four co-defendants on Monday said they would confess to terror charges that could bring the death penalty but postponed their guilty pleas.
“The accused in this case had decided that they wished to withdraw all motions ... and wished to enter pleas in what was termed as confessions in this case,” said Army Colonel Stephen Henley, the judge of the military tribunal at the U.S. naval base at Guantanamo Bay, Cuba in pre-trial proceedings.
He also read out a letter submitted by the defendants that they wished to dismiss their tribunal-appointed attorneys, scrap pre-trial motions and plead guilty to the terror charges.
But after a recess, Sheikh Mohammed and two co-defendants changed tack, saying they were postponing their guilty pleas pending mental competency evaluations of the two other defendants, Ramzi bin al-Shibh and Mustafa al-Hawsawi.
“I think I would like to withhold or postpone our pleas until after the decision is made about our other brothers bin al-Shibh and Hawsawi,” Sheikh Mohammed told the judge.
Walid bin Attash and Ali Abdul-Aziz Ali also postponed, with Ali saying the move signaled the desire to present a united front in the tribunal. “Our plea request is based on joint strategy,” Ali said.
The three indicated they still intended to plead guilty but will not do so until they find out whether the two other defendants will also be allowed to sack their lawyers, withdraw their motions and plead guilty.
“We don’t want to waste time,” Sheikh Mohammed earlier told the judge in English. He appeared before the court dressed in white and wearing a white turban, with a long gray and black beard.
“I don’t appreciate between the judge and my attorney and Bush and the CIA who tortured me,” he said, adding that he also did not trust Henley.
Sheikh Mohammed, captured in Pakistan in 2003 and handed over to U.S. agents who held him in secret prisons for more than three years before sending him to the detention facility at Guantanamo Bay, is known to have been subjected to harsh treatment by the CIA, including “waterboarding,” or simulated drowning, leading to controversy about the admissibility of his reported confession.
The judge had allowed Sheikh Mohammed, bin Attash and Ali to withdraw all their motions and go to pleas, but he refused to allow the same for two other defendants on concerns they were not mentally competent.
“The law compels me to order some additional testing” on the mental competency of Mustafa al-Hawsawi, Henley said after the defendant’s U.S.-appointed lawyer requested a medical evaluation.
It was not clear exactly when the formal guilty pleas would be entered for the first three defendants and, if allowed, the other two undergoing evaluation.
But with the judge postponing argument on the case’s motions—and proceedings shifting to testimony of four witnesses involved in the influence of an Office of Military Commissions legal adviser over prosecution teams—there was growing expectation that pleas would not be entered this week, and increasing likelihood that they would not be heard until the next year.
The five men, all formally charged in June, were watched at the tribunal proceedings by five relatives of those killed on 9/11. The victims’ kin sat in the back of the courtroom behind transparent acrylic glass.
It is the first time that relatives of those killed in the 2001 attacks in New York and Washington have been allowed to observe a trial in Guantanamo.
Alice Hoglan, mother of 9/11 victim Mark Bingham, said she was “really proud that the commission is proceeding in its slow and thoughtful and deliberate way, despite the histrionics of these guys.”
“I’ve had quite a long time to think about this moment and I’m not surprised to see how hostile they are,” she said.
Human rights groups groups quickly blasted the proceedings.
“What should have been a major victory in holding the 9/11 defendants accountable for terrible crimes has been tainted by torture and an unfair military commissions process,” said Human Rights Watch official Jennifer Daskal.
“Anyone who believes that this is a victory for American justice is sadly mistaken,” American Civil Liberties Union executive director Anthony Romero said.

The most they can accuse Khalid Omar of is being a pious religious man and following the dictate of his religion to contribute to jihad against the unbelievers. And that ain´t a crime in Western legal code.

WilliB-This case of Khalid Sheikh Mohamed and his life, his war actvities,should be made more public. His life dictates was made by circumstances in his life and his family members life.
All his brothers were killed in Soviet-afghan war which Osama/al qaeda members all also participated,so he had plenty reasons for revenge for his brothers lost lives in Soviet-afghan wars and against west/soviets.
There should a detailed book written on him/alqaueda/9/11 and other activities in detail,and on his ties with Osama.
Khalid should be given life sentence and not killed.He has much knowledge,which western world people needs to know and understand. Just like hitlers third reich anti UK/US movement politics,his alqeada is movement against West/UK/US.
He was a very important member of anti west-anti jewish wars and their cause. He wanted and created this war outfit against the west so did many others.
All people fighting afghanistan,in iraq,in suicide bombing do it, because they believe they have fight against the west and its corruptive influences. KSM brothers were all killed in during times of soviet union west control of afghanistan. The Pashtuns in afghanistan believe the creation of pakistan has taken away their homelands in NWFP,Fata to be given away to Islamabad in 194Os.The unfair carving of land in by colonial masters divide and rule policies,are still being felt today everywhere,is reason for wars from 2001.
This is one of reasons for continued war by pashtun militants for control in NWFP,FATA,Peshawar and elsewhere. They wars will continue long until the west really understands the politics taking place among the pashtun people in afghanistan,NWFP and FATA.
The trial of KSM,should go on long and his trial need more public airing,so that US people really understand all the complicated politics of his activities together with that of all supporters of his movements. Actually these activities against west/jews began since palestine woes started in 1940s.
There was the attack on Mecca in 1970s,by osama relatives(osama's uncle),the the subsequent killing of his relative by Saudi government that lead subsequently to early formation of Alqaeda militants by Osama/KSM to seek revenge.
The attacks in 1970s on mecca,Saudi arabia, was a protest to presence of western troops in Saudi as result of Iran-Iraq affairs.These incidents and many others is reason for continued al qaeda political activities in Saudi and Middle east nations.
There is a politics going among arabic speaking people that few know about in detail,but is only known among the arabic speaking elite political community in arabic.
The killing of anwar sadat by assassin islambouli is another political event that is very much related to the middle east affairs. Islambouli is regarded as a hero by Iran Revolution people,who desposed the Shah and subsequently made Iranians anti west sentiments rise. Ayman al Zawahiri was also sent to prison in Egypt,because of his role in Anwar asassasination.Later after release from prison in 1980s, Ayman al zawahiri joined up with KSM/Osama.
Peace will only come via detail understandings of the complex poltics in middle east arab/talibani politics that has been happening since 1940s. These historical politics in middle east/afghanistan and their informations expansions ,need more expansions.
There many more details to these complex politics of middle east/afghanistan-iran,my version is just a very unsophicated botchy one,with many flaws in them,that need more correction in details and accuracy via many other JT readers on JT.

No, it isn´t. For better or worse, the West has decided to grant freedom of religion to all religions, without considering their content. Hence, jihadism can be taught and we can´t do a thing about it.
Depends what you call "mainstream". The jihadists certainly include the violent jihad, and there are enough clerics who support them.
