Goes to show that the liberal 9th Circuit (often referred to as the 9th circus in many legal circles) failed to deliver justice to the victim and her family.

By the way, what an ugly mugshot. No wonder this creep had to prey and rape an intoxicated woman.

Alexis de Tocqueville was right when he said that the American practice of electing judges would lead to disaster. No other country in the world chooses their judges by holding a popularity contest. These campaigner would be better served by trying to abolish the entire system rather than recalling this one particular judge.

Yeah, choosing judges by election, but forcing them to make decisions based on the rule of law, seems to place them in a position that where they cannot satisfy the requirements of their position, and continue to keep that position. So they either need to go by the rule of law, and work a short time, or subvert the rule of law in order to keep their jobs. It's an absolute mess.

Whether judges are elected or appointed is not the issue. The fact is this Judge handed down an inappropriate sentence based on favoritism. That favoritism scandal seems based on his Anglo face than the horrific evidence. This judge has got to go.

The judge, rightly or wrongly, was probably being merciful about sending this young, blue eyed, pretty faced guy to a maximum security prison where he'll more than likely be the belle of the ball the moment he steps through the door.

I believe this judge has to go too. But we should be blaming the liberal-influenced 9th Circuit Courts who do not throw the book as hard as the 5th Circuit Courts in those red states . . . . regardless of the color of the convicts

Good point. If he were Black or Hispanic, he'd be facing several yrs. if not more. Its not fair.

Apparently the judge did not blink an eye after the father of Turner's father told the court "his son was paying a steep price for only "20 minutes of action".

Should throw the Father and Son both in the same jail cell for a year. -Misery deserves company.

I apologize. My comment should read: Apparently the judge did not blink an eye after Turner's father told the court his son was paying a steep price for only "20 minutes of action".

Turner is appealing his convictions of felony assault and attempted rape.

Appealing his conviction doesn't appear to be a smart move. Currently, the most he'll spend in jail is about three months. On appeal, he could get a different judge who might sentence him to years in prison. Even if he gets the same judge, due to all the negative publicity, I doubt that judge would be as lenient during a second trial.

Are you totally incapable of putting down the Culture War hatchet for even a moment? WTF does this have to do with the Ninth Circuit? Persky is a Santa Clara County Superior Court Judge, and has nothing to do with the federal court system.

Judge election Elected judges have to campaign like politicians. He will not be elected if he has a little bit of smear as voters are not forgive anything he or his family member did wrong and he won't be elected but this judge, no one can wait re-election. Thus more than one million people signed for recall.
