  Make it illegal. Seems to work in the USA. The law-abiding Japanese will surely stop when it's against the law.

  Apple didn't invent the MP3 player - Rio did. Apple didn't even invent the HD-based MP3 player - Archos did. Apple makes very appealing products - they aren't really ahead of the curve products.
