(1.) Yes, if the patron appears to be visually intoxicated, otherwise no. Owners are also vicariously liable for their employees as well, but only in a civil court and not criminal.
(2.) No, neither, in a civil court nor a criminal court, unless the passenger were a parent, or a driving school instructor, and they had knowledge that the driver was intoxicated. They yes to both civil and criminal.

60 Minutes did a special a few years back on Medical Marijuana. There actually are some people in the US who smoke government issued pot.
The pot comes in a can which contains about 30 or so pot cigarettes.
It would be nice if they would lower the threshold that one must meet to obtain a prescription for govt issued pot.
There are so many people out there whose quality of life would vastly improve if they had access to pot when they felt like it.
It stimulates the appetite, it can increase ones libido, it can also put you to sleep and different from overdrinking you wake up with no hangover.
But, that would be the wise thing to do and as we all know that probably is not going to happen in our lifetime. Then again, maybe it will.
It seems a lot of these Japanese kids are getting busted because they can't keep their mouths shut. If they would get high in private and not tell their friends about it they would be doing themselves a favor.
I really feel sorry for that young woman from Doshisha because as a previous poster pointed out, her life is probably ruined, not to mention her relationship with her parents.
How can a parent do that?

The only one who know's why McCain choose Palin is McCain.
The only executive experience that Palin has that matters is that she abused the power of her office, and has not yet apologized to the voters of Alaska for that terrible breach of trust and breach of her constitutional oath.
And while she was abusing her power, her teenage daughter was out getting pregnant. She is a failure as a parent and a mother. Is that what "taking on the old boys" means?
The only visceral thing Palin evokes in Americans is fear and shame, fear that one day this nitwit could be President of the United States, and shame that this is the best that McCain could do.
As Gen. Colin Powell put it, the day McCain choose Palin he betrayed the American people, and the Republican party.

Glad he's gone.
Now we will have to hear his name no more.
This was not a high-profile case in the States, except maybe some communities in LA, and they will forget soon.
Kudos to retired LA cop Jimmy Sakata for not giving up and finally bringing this weasel back to the US.

I live in the US so the below is based on my use in the US. I hope it is helpful to you.
The GPS feature works with your address book in getting you from point A to point B, or it can work alone much the same way a GPS device works except there is no voice application, yet.
DISPLAY: You can choose either map, satellite, hybrid or list for your display.
GETTING FROM POINT A TO POINT B: Say you are in front of Shinagawa station and want to go to some restaurant in Shibuya. If you have that restaurant in your address book all you have to do is choose:
START: "current location" END: (Here your a blue icon appears, you can then choose from BOOKMARKS (Your favorite places that you have saved as favorites) RECENTS (recent choices you have made) or CONTACTS (Your contacts in your address book).
If you choose CONTACTS, your contact book will appear with the alphabet listed on the right side. You tap the first letter of the restaurant and that section will appear, you scroll up or down till you find the restaurant tap that and it will calculate and tell you how far you are, how many minutes it will take in traffic at that time, and then give you a step by step guide to your destination.
And then it will save that trip you just made from Shinagawa to Shibuya in RECENTS in case you need to make it again.
It is really sweet and is more up-to-date than many GPS units that allow you to download updates free on your PC like TOMTOM for instance.
Here in the US it gives you the up-to-date traffic situation color coded with red being heavy traffic, yellow not-so-heavy, and green wide open. It will also give a very accurate time it will take for your journey. (This is all predicated upon one driving an auto.)
I wonder what it will be like in Japan with the trains etc ....
Anyway, the hype will soon die down and they will be giving them away.
Unlimited usage here in the States with AT&T is about $105-$125 per person a month. For that you get: Unlimited Internet, unlimited text SMS messaging, free AT&T account person-to-person calling, free international calling in and out, and discounted international in and out, (I forget what I pay for international but it's not too bad) 2500 minutes per month domestic, which rollover and all those taxes, fees etc.
$125 per month is pretty close to what youdontknow said he/she was paying in the UK.
I found a pretty good guy at my local AT&T store and go in to see him any time I have a complaint or question about the bill, he takes care of me right away and issues refunds to my credit card on the spot.
If anyone has theirs now please let me know how much it is per month in Japan.
I have never dealt with Softbank, so good luck.

It is a civil matter and surely not illegal.
I am not sure what you mean by xenophobic in this context, but Softbank protecting their own pecuniary interests is good business.
If you can't afford the friggin service don't sign a K with Softbank.
If you can afford the service, bite the bullet, sign their petite one-sided K, and walk out with your iPhone.
(I have had one for about a year, and it makes life a lot easier. For me it is worth every penny.) If you think Softbank is ripping you guys off in Japan compare it to what AT&T charges in the States.
