so if the new jury system sides with the father that the original crime took place in the USA, then this would force the gov't to protect children and sign the 1980 treaty. That's probably a good thing.

interesting that Japan has ignored an International treaty on this issue since 1980. Extradition and crime of the original abduction in the USA also is "normally" tried in a case like this, but this is Japan. They didn't sign.
