A police officer in Iwate Prefecture has been arrested for defamation of character after he allegedly posted naked photographs of a female acquaintance onto an Internet message board without her permission.
According to Iwate prefectural police, the suspect, identified as Koji Takahashi, a 36-year-old subsection chief in the traffic division, uploaded several naked photos of the woman, a resident of Aomori Prefecture, from his home computer, TV Asahi reported. Police said Tuesday the crime was discovered when investigators received an anonymous tip-off.
At a press conference in Iwate, a police spokesperson said, "This kind of incident is extremely regrettable, especially in an earthquake-hit area at a time when we are pooling our manpower and require every officer available to help maintain law and order," TV Asahi reported.

Actually, the law is wrong. Since there was no contractual obligation to prevent him from posting these pictures he is the owner of the copyright, so basically he can use these pictures anyway he like, including distributing them on the Internet.
People should be responsible in protecting their own privacy, for example not sending nude pictures of self to some dumb cop. Limiting freedom of speech for privacy concern is hurting journalism. There is a fine line between free press and government controlled media, and i think this law crosses the line.

On the other hand, she is the owner of the copyright of her own image. Also, I think its a misapplication of the intent of copyright to give it to a non-professional in a private setting. So I think the issue of copyright is moot.
You also say there is no contract, but we could also argue that there is an implied contract to not show these pictures to others. It is very hard to find a woman who would be happy to have the nude pictures a guy took of her during sex play posted on the net surreptitiously. That goes even if she sent him the pictures herself. You know it. I know it. The contract to keep the pictures private is pretty obvious. No one should ever have to state "Please don't show these embarrassing pictures to others." Not only does it kill the mood, it goes without saying.
But the tack taken by the complaintant is defamation of character. I don't see any problem with that. Again, these pictures were obviously meant to be private. Everybody knows such pictures released publicly can damage a person's reputation. And there is not one drop of public good served by these pictures to try and use that as a way out (like copyright law if it were applicable, and I don't think it is).
I am very glad to see this bum get arrested for this and let it be a lesson to all those idiot males who make so many women apprehensive of us all because of short sighted selfish actions like this.
And now I can only hope the court will convict the bum and not let him off on some imaginary need for a new law since a computer and the internet were used. He defamed her character for his own selfish jollies, as if the jollies he got that night were not enough. How he did that damage is irrelevant. That said, I would support a new law to make this a clear and specific crime so that idiot men won't do it anymore.

It is standard procedure to require a release before a photographer can publish the image of someone. Yes, the photographer owns the copyright on the image because he's the one who framed and created the image, but all that does is prevent someone ELSE from publishing the image without his approval. He STILL needs permission from the model before he can publish an image of that model. In this case he failed in that regard.

I imagine the problem lay in showing her face. Might he have blackmailed her in some way, threatening to post pics he had previously taken of her? So many possibilities here, before we go about blaming anyone.

That said, I always thought "defamation of character" was a civil action, not a criminal one. I guess the laws in Japan are different in that regard. In the U.S. you could get sued for defamation, but not arrested.
